The use of the website www.fado.ro (hereinafter referred to as the "Site"), including visiting, registering, using the services or products offered, ordering products through the Website, implies full acceptance of the terms and conditions of use which will be described below, on this page.
For the good use of the Site, it is recommended to carefully read all the Terms and Conditions.
We reserve the right to make changes to the Terms and Conditions page without prior notice.

1. Definitions and terms:

Seller/Supplier is S.C. Fado S.R.L., in general, any natural or legal person acting in the framework of its commercial activity.
Buyer - can be any natural person over the age of 16 or legal person who creates an Account on the Site and/or places an Order.
Customer - any natural person who is over 16 years old or legal person who has or obtains webshop access,
through any means of communication made available by S.C. Fado Trade S.R.L. (electronic, telephone, etc.) or based on a user agreement.
User – any natural person who is over 16 years of age or legal entity registered on the Site, who, by completing the account creation process, has agreed to the terms of the Site in the Terms and Conditions and Privacy Policy section .
Website – online store hosted at www.fado.ro
Product - any tangible movable asset is considered "product" when it is put on sale in limited volume or in fixed quantity;
- Product made according to the customer's specifications - any product that is not prefabricated and is made based on the customer's individual options;

- Special order - any product ordered from suppliers specifically at the customer's request and/or package of products assembled/prepared at the customer's special request.
Favorites – the section of the Account that allows the Buyer to create Lists of the Products they want to track.
My Cart – section of the Account that allows the Buyer to add the Products they wish to purchase.
Order – is an electronic document that acts as a form of communication between the Seller and the Buyer through which the Buyer conveys to the Seller, through the Site, his intention to purchase Products from the Site.
Distance contract - any contract concluded between the Seller and the Buyer within a distance sales system, organized without the simultaneous physical presence of the Seller and the Buyer, with the use of one or more means of distance communication, until the moment it is concluded the contract;
The contract is considered concluded when the Buyer receives from the Seller, by means of e-mail and/or SMS, the notification of dispatch of the Order.

Content means:
– all the information on the Site that can be visited, viewed or otherwise accessed by using an electronic device;
- the content of any e-mail sent to Buyers by the Seller by electronic means and/or any other means of communication available;
- any information communicated by any means by an employee/collaborator of the Seller, the Buyer, according to the contact information, specified or not by him;
- information related to the Products and/or Services and/or the rates applied by the Seller in a certain period;
- information related to the Products and/or Services and/or the rates applied by a third party with whom the Seller has concluded partnership contracts, during a certain period;
- data related to the Seller, or other privileged data of the Seller.
Commercial/marketing communications – any type of message sent (email/SMS/telephone/mobile etc.) containing general and/or thematic information, information regarding offers or promotions and/or information regarding the Products.

2. Contract documents:

2.A - By registering an Order on the Site, the Buyer agrees to the form of communication (telephone or e-mail) through which the Seller conducts its commercial operations.
2.b. - The notification received by the Buyer, after placing the Order, has the role of information and does not represent the acceptance of the Order. This notification is made electronically (e-mail) or by telephone.
2. c. - For justified reasons, the Seller reserves the right to change the quantity of Goods and/or Services in the Order. If he changes the quantity of Goods and/or Services in the Order, he will notify the Buyer at the e-mail address or phone number provided to the Seller when placing the Order and, as the case may be, will return the extra amounts collected.
2.d. - The contract is considered concluded between the Seller and the Buyer at the moment the Buyer receives from the Seller, via e-mail and/or SMS, the notification of the dispatch of the Order.
2.E -. The document and information made available by the Seller on the Site will form the basis of the Contract, supplemented by the warranty certificate issued by the Seller or one of its suppliers for the purchased Goods.

3. Disclaimer:

The content of the site has been created with great care, regarding the correct entry of data and compliance with the accuracy of the information. However, errors are not impossible.
Therefore, the Supplier does not assume responsibility for printing or display errors in prices, features, images, etc. In the event that the price of the product or some of its characteristics have been incorrectly entered into our databases or displayed incorrectly, and the delivery has not yet been made, the Supplier reserves the right to cancel the delivery of the respective product and notify the customer as soon as possible shortly about the error that occurred.
Also, the images of the products presented on the website are for information purposes, as such, the delivered products may differ from the presentation images in any way, due to changes in the characteristics, design, without prior notification by the manufacturers.
The maximum value of the Supplier's obligations to any customer, in the event of non-delivery or improper delivery, is the amount collected by the Supplier from that customer.
SC Fado Trade SRL does not guarantee the availability in stocks of all displayed products. Therefore, the Supplier assumes the right not to honor a certain order in case that product disappears from the current offer.
The published prices are informative and may undergo unannounced changes.
SC Fado Trade SRL is not responsible for damages, costs, lawsuits, claims or expenses arising as a result of non-compliance by users with the "Terms and conditions.
SC Fado Trade SRL is not responsible for damages caused as a result of the site not functioning, as well as for damages resulting from the impossibility of accessing certain links published on the site.
We also reserve the right to suspend accounts when we believe, that they may harm our company or other Users.

4. Obligations and conditions for invoicing

In the case of orders placed, payment methods and terms are specified, as well as the final price, which will be included on the fiscal invoice issued by the Seller to the Buyer. The buyer has the obligation to provide all the information necessary to issue the tax invoice, according to the legislation in force.
So:
 - in the case of legal entities, the following data must be provided: Company name, CUI, ORC registration number, headquarters address, bank account and delegate data
 - in the case of natural persons, the following data must be provided: Name, Surname, address from the identity document, e-mail address, telephone number, etc.
If the Customer refuses to provide this data, or we suspect that this information is not real, we reserve the right to cancel the order made by him.

5. Delivery of products:

The Seller undertakes to deliver the Products to the Buyer in the courier system agreed by the Seller, or through SC Fado Trade SRL's work points or dealers, according to the Customer's option, within the term established upon completion of the contract. If the Buyer has chosen the method of payment by payment order, then the delivery will be made only after the payment has been made.
Shipping costs will be added to the price of the Products. Before the delivery of each individual order, the Buyer will be contacted.
The Seller will ensure the proper packaging of the Products and will ensure the transmission of the accompanying documents.
The Seller will deliver the Products only on the territory of Romania.

6. Transfer of ownership of Products:

Ownership of the products will be transferred upon delivery, only after full payment has been made by the Buyer, at the location indicated in the Order
(by delivery is understood – the signature of receipt of the transport document provided by the courier or the signature of receipt on the tax invoice/transport document in the case of deliveries made by the Seller's staff).

7. Promotions, discounts:

SC Fado Trade SRL reserves the right to organize promotions, discounts, contests, raffles, in compliance with OG no. 99/2000.

8. Intellectual property right:

The entire content of this website is the property of SC Fado Trade SRL and is protected according to the Copyright Law and laws regarding intellectual and industrial property rights (Law no. 8/1966 updated).
The use of any element without the prior consent of SC Fado Trade SRL is punishable according to the Romanian laws in force.

9. Confidentiality:

SC Fado Trade SRL will maintain the confidentiality of information of any nature provided by the Buyer.
The disclosure of the information provided will only be possible under the conditions mentioned in the Privacy Policy page. More information on the page – Privacy Policy.

10. Warranty:

The warranty period comes into effect from the date of the invoice. The seller guarantees that, in case of failure under normal conditions of use/exploitation, during the warranty period, the product will be repaired free of charge, or if it cannot be repaired, it will be exchanged for another identical product.
The guarantee is granted only on the basis of the invoice and if the products have the original packaging and complete contents. Please return the complete package with the items mentioned above.
(Return costs will always be borne by the Buyer).
The following situations lead to the removal of the products from the warranty: interventions or repairs performed by unauthorized persons; non-compliance by the Buyer with the storage and maintenance conditions.

11. Disputes:

In the event of any conflicts between SC Fado Trade SRL as the owner of this Site and its customers, an attempt will be made to resolve them amicably.
In the event that an amicable solution will not be possible, the conflict will be resolved at the competent Courts in accordance with the Romanian laws in force.

12. Force majeure:

Force majeure is an unforeseeable event beyond the control of the Seller or the buyer.
Neither party shall be liable for failure to perform its obligations if such failure is due to such an event.
By placing an order on this Site, the customer accepts without objection the Terms and Conditions of Use and fully assumes his rights and obligations.
